1. Acceptance of Terms
By accessing or using StackDive™ ("the Platform"), operated by FAR CNCPT LLC ("the Company", "we", "our", or "us"), you agree to be bound by these Terms and Conditions. If you do not agree to these terms, you may not access or use the Platform.
2. Description of Service
StackDive™ is an interactive knowledge transfer platform operated by FAR CNCPT LLC that provides guided code walkthroughs, AI-powered tutoring, copilot simulations, and hands-on coding exercises. The Platform is designed to help developers understand software architecture, code patterns, and AI tool workflows.
3. User Accounts
To access certain features, you must create an account via our authentication provider. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must provide accurate and complete information and keep it updated.
4. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, or disassemble any part of the Platform
- Interfere with or disrupt the Platform or servers connected to it
- Scrape, crawl, or use automated means to access the Platform without permission
- Share your account credentials with others or allow unauthorized access
- Use the AI tutor to generate harmful, misleading, or malicious content
- Redistribute or resell course content without authorization
5. Intellectual Property
StackDive™ is a trademark of FAR CNCPT LLC. The Platform's interface, design, walkthrough annotations, AI tutor system, and original educational content are owned by FAR CNCPT LLC and protected by intellectual property laws. Open source code displayed on the Platform remains subject to its original license terms.
The StackDive™ name, logo, and all related marks are trademarks of FAR CNCPT LLC. You may not use these marks without prior written permission from the Company.
All other product names, logos, and brands referenced on the Platform — including, without limitation, Microsoft® and Microsoft 365 Copilot™ — are the property of their respective owners. Their use on the Platform is nominative and for educational and illustrative purposes only. StackDive and FAR CNCPT LLC are not affiliated with, endorsed by, or sponsored by any such third party, and no such affiliation should be inferred.
6. Open Source Content
The Platform displays code from open source repositories. This code is subject to its respective open source licenses (MIT, Apache 2.0, GPL, etc.). StackDive does not claim ownership of open source code. Our walkthroughs and annotations are educational commentary on publicly available code.
7. User-Generated and Organization Content
The Platform allows users and organizations to create, upload, import, or otherwise submit content, including custom courses, walkthroughs, lesson content, and code repositories connected via third-party integrations (“User Content”). You retain ownership of your User Content.
By submitting User Content, you grant FAR CNCPT LLC a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and process that User Content solely to operate, provide, secure, and improve the Platform for you and, where you direct, for members of your organization. This license ends when you delete the User Content or your account, except for content already shared with your organization and for backups retained for a commercially reasonable period.
You represent and warrant that you own or have the necessary rights to your User Content and that it does not infringe any third party's intellectual property, privacy, or other rights, and does not violate any law or these Terms. You are solely responsible for your User Content and for connecting only repositories or data you are authorized to use.
8. Copyright and DMCA Policy
FAR CNCPT LLC respects the intellectual property rights of others and responds to notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act (“DMCA”, 17 U.S.C. § 512). If you believe content on the Platform infringes your copyright, send a written notice to our designated agent at dmca@stackdive.appthat includes: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and information reasonably sufficient to locate it; (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
We may remove or disable access to allegedly infringing material and, in appropriate circumstances, terminate the accounts of repeat infringers. If you believe your content was removed in error, you may submit a counter-notice to the same address. Abuse and takedown requests unrelated to copyright may be sent to abuse@stackdive.app.
9. AI Tutor Disclaimer
The AI tutor provides automated explanations and code analysis. While we strive for accuracy, AI-generated responses may contain errors or inaccuracies. The AI tutor should be used as a learning aid, not as a definitive source of truth. Always verify critical information against official documentation.
10. Subscription, Payment, and Cancellation
Some courses and features require a paid subscription or credit-based access. Pricing, billing cycle, and plan features are shown on the pricing page and on the checkout screen before you pay. Payments are processed by Stripe. Prices are in US Dollars unless otherwise noted.
Automatic renewal. Paid subscriptions renew automatically at the end of each billing period (monthly or annual, depending on the plan you chose) at the then-current price for that plan, using the payment method on file. By subscribing, you authorize FAR CNCPT LLC to charge your payment method on each renewal date until you cancel. Your subscription will continue to renew until you cancel.
How to cancel. You can cancel at any time — without calling, emailing, or explaining — directly from the Billing page, which opens the Stripe customer portal. Cancellation takes effect at the end of the current billing period; you will keep paid access through that period and will not be charged again. You do not need to cancel the free Explorer tier — it has no recurring charge.
Annual plan renewal reminders. If you are on an annual plan, we will send a reminder email to the address on your account between 7 and 14 days before your annual renewal so you have time to cancel or change your plan before you are charged again.
Refunds. For first-time subscription purchases, you may request a full refund within 14 days of the original charge by emailing billing@stackdive.app from the address on your account. After that 14-day window, subscription fees are non-refundable except where required by applicable law. One-time purchases (credit packs) and AI credits that have already been consumed are non-refundable. Unused, unconsumed credit pack balances may be refunded at our discretion on a case-by-case basis.
Price changes. We may change subscription prices from time to time. If we raise the price of a plan you are subscribed to, we will notify you by email at least 30 days before the new price takes effect at your next renewal. You can cancel before that renewal if you do not wish to continue at the new price.
Failed payments. If a renewal charge fails, Stripe will attempt to retry the payment according to its standard schedule. If payment has not succeeded within 7 days, your paid features (including AI credit grants and premium course access) may be suspended until payment is resolved. Your account data, progress, and free-tier access are not affected during this grace period. If payment has not been resolved within 30 days, the subscription will be cancelled.
This section is designed to comply with applicable automatic-renewal and consumer protection laws, including the federal FTC Negative Option / "Click-to-Cancel" Rule and state Automatic Renewal Laws (ARL) such as California's. If any provision of this section conflicts with mandatory consumer protection law in your jurisdiction, the mandatory law controls to the extent of the conflict.
11. Limitation of Liability
To the maximum extent permitted by law, FAR CNCPT LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.
12. Termination
We reserve the right to suspend or terminate your access to the Platform at any time for violation of these Terms. Upon termination, your right to use the Platform ceases immediately. You may delete your account at any time through your account settings.
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after changes constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of North Carolina, United States, without regard to conflict of law principles.
